• Not patentable in Europe / EPO • Patentable in U.S., but cannot be enforced against “medical practitioners” – Commercial labs are not “medical practitioners” • Claim medical devices, to the extent possible, using apparatus claims • Relatedly, recite structure to the extent possible in the claims – As opposed to functional/method steps within an apparatus claim
