Trademark and Trade Dress

• A trademark comprises words, phrases, symbols or designs that identifies and distinguishes the source of the goods of one party from those of others.

– For example, the “Coca Cola” trademark

– For example, the design of the Coca Cola bottle

• Trade dress • Protected by “unfair competition” in some jurisdictions

• Generally cannot use someone else’s trademark to sell similar goods
